Note: The word “I” in the following agreement means myself as an individual person and/or the proprietorship named above and/or the partnership or corporation named above which has authorized me to legally represent it.


Safety Agreement:
I am familiar with safe self-service fueling procedure for cars and trucks. I understand and agree that smoking, open flames, sparks or other sources of ignition are strictly prohibited at all fueling locations. I understand that vehicle engines must always be turned off before fueling. I understand that filling of glass or other unapproved containers is illegal and prohibited.


Lost or Stolen Cards:
I understand that I am responsible for all charges applied to my account. In the case of a lost or stolen card, I am liable for all transactions up until two hours’ time after which I have contacted Acme/Fast Fuel and confirmation of the reported lost or stolen card(s) has been made. I also understand that I am responsible for any and all cards and subsequent transactions that I have released to employees, family members and all others and that Acme/Fast Fuel is not responsible for any misuse of the card(s) by these parties.


Credit Agreement:
Please note! Payment of purchases made every 2 weeks is due on the 10th and 25th of the month or as otherwise agreed by the acme fuel credit department. In the event that I fail to pay any balance due, I understand that the balance will accrue interest at eighteen percent (18%) from the due date until paid in full. In the event that the past due balance is referred for collection, I agree to pay all costs of collection, including collection fees, actual attorney’s fees and court costs. New credit terms may be applied to the existing balance on your account unless prohibited by law. Past due accounts may be subject to a temporary or permanent lock out or freeze on use of the account if payment is not made to terms or express agreement has been set up on a case by case basis with the credit department.


I warrant that the information on this application is accurate to the best of my knowledge and that I am not submitting this application for the purpose of fraud or illegal activity.
For good and valuable consideration, including without limitation, the extension of credit by Acme/Fast Fuel to the above referenced company/individual applicant, the receipt of which is hereby acknowledged, the undersigned guarantor unconditionally and irrevocably guarantees to Acme/Fast Fuel, and to its successors and assigns, the full and prompt payment of all debts, obligations, and liabilities of the company/individual to Acme/Fast Fuel. Without limiting the foregoing, guarantor’s guarantee to Acme/Fast Fuel includes, without limitation, the reimbursement of Acme/Fast Fuel for reasonable attorneys’ fees, costs, and all other expenses incurred in collecting or compromising company/individual applicant’s indebtedness as guaranteed herein—including reimbursement for reasonable attorneys’ fees, costs, and all other expenses that may be incurred in enforcing this guaranty against guarantor. This shall be a continuing guaranty. Guarantor authorizes Acme/Fast Fuel (whether or not after revocation or termination of this guaranty) without notice or demand (except any notice or demand that is required by statute and cannot be waived) and without affecting or impairing their liability hereunder, from time to time to renew, compromise, extend, accelerate, or otherwise change the time for performance of, or otherwise change the terms of the indebtedness or any part thereof. Guarantor waives any right to require Acme/Fast Fuel to: (a) proceed against company/individual applicant; (b) proceed against or exhaust any security held from company/individual applicant; or (c) pursue any other remedy in Acme/Fast Fuel’s power. Guarantor waives any defense based on or arising out of any defense of company/individual applicant other than payment in full of the indebtedness. Guarantor waives all presentments, demands, and notices of any kind relating to this guaranty or any indebtedness. This guaranty shall remain in full force until guarantor delivers to Acme/Fast Fuel written notice revoking it as to indebtedness incurred subsequent to such delivery. Such delivery shall not affect any of the guarantor’s obligations hereunder with respect to indebtedness incurred prior to written notice of revocation. This guaranty and the rights, obligations, and liabilities under it are to be governed by the laws of the State of Washington. Guarantor agrees that exclusive jurisdiction for any legal action or proceeding arising out of or relating to this guaranty resides in the federal or State courts of the State of Washington and guarantor further agrees and expressly consents to the exercise of personal jurisdiction in the State of Washington in connection with any dispute or claim involving this guaranty.

The undersigned personal guarantor, recognizing that his or her individual credit history may be a necessary factor in the evaluation of this personal guarantee, hereby consents to and authorizes the use of a consumer credit report on the undersigned, by Acme/Fast Fuel, from time to time as may be needed in the credit evaluation process.

The Federal Equal Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract); because all or part of the applicant’s income derives from any public assistance program; or because the applicant has, in good faith, exercised any right under the consumer protection act. the federal agency that administers compliance with law concerning this credit is the Federal Trade Commission, Division Of Credit Practices, 6Th And Pennsylvania Avenue, NW, Washington D.C. 20580.
